That sounds like a great idea. It could even mark the affected clusters as broken to prevent using them. FDISK itself should probably show a big warning when it sees overlap, but I do not know whether just truncating the overlapping partition would not cause too many side effects itself. At the very least, DOS
will be upset about mismatching partition and filesystem (boot sector data) sizes.

Also thanks to everybody who is investigating what and why FDISK messes up!
